Update: We’ve reached out to Samsung AU asking what the difference between the Galaxy Tab 10.1 variant Apple complained about and the one Samsung plan to sell here is.

After reaching out to Samsung late last night for a statement in regards to Apple’s complaint to the Federal Court of Australia about the Galaxy Tab 10.1 and its likeness to the iPad, they’ve gotten back to us with the following:

Apple Inc. filed a complaint with the Federal Court of Australia involving a Samsung GALAXY Tab 10.1 variant that Samsung Electronics had no plans of selling in Australia. No injunction was issued by the court and the parties in the case reached a mutual agreement which stipulates that the variant in question will not be sold in Australia.

A Samsung GALAXY Tab 10.1 for the Australian market will be released in the near future.

This undertaking does not affect any other Samsung smartphone or tablet available in the Australian market or other countries.

Samsung will continue to actively defend and protect our intellectual property to ensure our continued innovation and growth in the mobile communication business.

So that’s what Sammy AU had to say. They aren’t planning on selling the variant of the 10.1 that Apple have complained about and have settled with Apple (no doubt $$$ involved). Samsung will follow through with their plans to bring the Galaxy Tab 10.1 to Australia, it just won’t be the one Apple have complained about.

This has got the be the worst product i have ever seen.. instead of making my life easier as it should it has complicated it to the point where i want to take my ipad2 and its useless operating system and throw it on the ground and watch it break into a thousand pieces. I then want to take a hammer and break each of those thousand pieces into thousands of smaller pieces. OK guys, here’s some homework.  What is this variant?  Why would an Aussie 10.1 be different to a US 10.1 (especially the wifi only models).  When you take into account that it seems only the Australian 10.1 is being stopped by Apple wheras they seem to be “just fine” with the US models?
I am getting more curious by the day.

Yup, mission now is to find out the exact differences between the variants. Not that i think it will be but i hope that we are not looking at an inferior model. As for these patent “experts” and where they came from and why they have bothered to give in such detail their take on everything, consfuses me. Are they rivals or something? I disagree with Florian Mueller.  There is no reason to believe that there is any weakness or concession in Samsung’s actions.  Apple would never have got the injunction it was asking for, and the matter may still go to trial regardless of the features of the Australian ‘variant’.  With the amount of litigation the two companies have underway in a number of more important markets, why would Samsung start shaking in their boots over a skirmish in Australia? Perhaps the missed story so far are the quotes from samsung that the Aussie 10.1 will be different than the USA one (P7500), dies this mean another less supported 10.1V (P7100) ??
or are those comments on a different 10.1 just lawyer speak or superficial.

we must remember that apple still has 7 days with the 3 galaxy tab 10.1’s. They will go over it with a fine tooth comb and look for the smallest of infringements. Problem is in the tech industry its always possible to find some overlap in technologies. so this should be interesting.

Also remember that during the 7 days that apple has those tabs, samsung are not allowed to advertise promote pre-sell or sell the tab based on the official court documents that i read through.

won’t be suprised if apple were to take apart the galaxy tab and reverse engineer it.  whether be the processor and or ways of making their tablets thinner.  all this patent issues is just another way to get a hold of other companies products.  isn’t that a patent infringement in itself?

they’re not going to give you an inferior product. the lawsuit is about the alleged similarity in design, but in reality it’s all about Apple being seriously threatened. Let’s face it, Smamsung’s product in superior in almost every way, bar the fact that apple has itunes (which is a positive only due to it’s greater size). I fail to see how anyone can be in love with apple’s products. As an owner of an iphone (not by my own choice, as it was a gift), I’m frustrated by it DAILY. Storm in a teacup. My reading of the Bloomberg report was accurate then. There was no court ruling, no injunction and no blocking, only an “out of court” agreement between two companies. I suspect Apple won’t give up too easily though, being the fat patent troll that they are.

The phrase ‘storm in a teacup’ often refers to media hyping up information in articles, making readers think there is more to something than there actually is. Journos are good at it. That’s what I meant but I didn’t make it clear enough I guess. I’m specifically referring to Bloomberg. People unskilled in understanding sentence construction are easily led to believe some thing different to actual events. Ambiguity and perception are tricky things to grasp.

I have to agree with you there, but in this case i dont actually mind it. 😉
I have to say that the bloomberg article did seem confusing. First stating that they wouldnt be allowed to sell the tab. Then saying they had to give apple 3 copies 7 days before it went on sale. Conflicting info.

I KNOW, right? Can’t believe apple is this stupid! But they’re not, really, they’re desperate. The Tab offers so much more, and the Apple know it. Not only it it more, but it more that Apple could EVER give, if they continue with their current half-baked and never as good as it can be policy. The best they can get out of it is to put a black mark on the Samsung name, but I doubt that they’ll get that.. Samsung has little to lose.Â
