Here at Ausdroid we’ve been covering the Apple vs Samsung story since the claws came out at the end of July.

So after the court hearing on 1st August 2011, the Australian Federal Court ordered that Samsung “will not without the licence of the first applicant [Apple], import, promote, offer to supply, supply, offer for sale or sell in Australia the Galaxy Tab 10.1 device…” until after today’s hearing.

Today Samsung told the Australian Federal Court that it would postpone the release of its Samsung Galaxy Tab 10.1 until September 30th and would give Apple 48 hours notice of it being available to consumers. There will be another hearing in the last week of September that will see the Australian Federal Court make a judgement on the case or see a new agreement made between the parties. Samsung and Apple will be back in court this afternoon for both parties to agree on the exact dates for their next hearing at the end of September.

The good news now is that Samsung is looking to turn the tables and file a cross-claim against Apple for patent infringement for the iPad. But it looks like we won’t be seeing a conclusion to the drama for another month.

In the meantime, Myer will have a bit of retracting/explaining to do after they advertised the Samsung Galaxy Tab 10.1 going on sale from the 1st September.

Good thing I got mine through Mobicity a few weeks ago. Awesome little device.

The Asus is good, but the extra weight and thickness means the galaxy wins in my book.

Read the fine print of the catalogue. They state that all items are subject to availability from suppliers. *Shrugs*
They would have finalised the spread before the original injunction was even filed. They certainly don’t have any “explaining to do”.
